Ohio Trust Code Duties & When They Generate Litigation

Ohio’s Trust Code, found in Title 58 of the Ohio Revised Code, establishes the statutory duties governing every trustee administering a trust in this state. The core obligations include the duty of loyalty, the duty of impartiality between current and remainder beneficiaries, and the duty of prudent administration over trust investments and distributions.

ORC 5808.13 adds a specific reporting obligation: trustees must keep current beneficiaries reasonably informed about trust administration and provide the material facts a beneficiary needs to protect their interests. This means delivering accountings, disclosing significant transactions, and notifying beneficiaries of changes that affect their rights. Failure to meet these disclosure requirements is one of the most common triggers for trust litigation in Ohio. Trustees who consistently comply with ORC 5808.13 also trigger the statute of limitations on potential claims, which may reduce long-term exposure. Beneficiaries who have been denied trust information have standing to file an action in Cuyahoga County Probate Court to compel disclosure and obtain a formal accounting.

Challenging the Validity of a Trust or Trust Amendment

Under Ohio law, a trust may be challenged on grounds that the grantor lacked capacity at the time of execution or was subjected to undue influence by someone who stood to benefit from its terms. Fraud and forgery involving trust documents or signatures are also recognized grounds for a contest in Ohio courts.

Trust validity challenges follow a different procedural path than will contests. The time period for challenging a living trust under Ohio law may be considerably longer than the three-month window that applies to will contests under ORC 2107.76. Contested amendments and unexpected beneficiary changes are among the more common scenarios that prompt validity litigation, particularly when those changes occurred late in the grantor’s life or during a period of declining health.
