Uniform Mediation Act adopted in Ohio for Trust Disputes

January 28, 2020, by Daniel McGowan, on New Probate & Trust Cases |

Effective January 1, all Ohio courts that use mediation must adopt the state's Uniform Mediation Act by local rule.  According to the Supreme Court, 77 percent of common pleas courts and 63 percent of state courts are in that camp.

The new rules come courtesy of the Supreme court's dispute Resolution Program and Commission on Dispute Resolution.  The pertinent changes are found in Rule 16-16.36 of the Rules of Superintendence and govern mediators who work with courts.  These changes can be studied here
