Ohio Court allows beneficiaries to challenge change of beneficiary designations

Recently, in Murphy v. Hall, 2019-Ohio-188, the Eleventh district Court of Appeals issued an opinion in an appeal challenging a trial court's holding that the decedent had improperly completed a change of beneficiary designation, which left the retirement account to the estate rather than the decedent's siblings.  The Court of Appeals reversed the decision finding that the weight of the evidence showed that the decedent intended to leave an interest in the account to each of the siblings instead of the estate.
